7th Ed. Character Victory Point Question

Okay so reading the rules. If a hero with two wounds is in a unit and loses a wound, but the unit itself is not reduced to half points; do I still get half the hero's victory points?

Also if a giant does a throw back in combat, can the creature he tossed still fight back that turn if it survived?

1. Hero still gives half points, no matter where he is.

2. The rules don't say, but there is nothing to say the model thrown back into combat can't attack.
